David Meltzer, entrepreneur, podcaster, recently had Jotham Stein on his podcast, The Playbook.
Here’s what Stephen F. Diamond, a Silicon Valley board member, consultant and business law professor at Santa Clara University School of Law, has to say about Jotham’s latest book:
“Silicon Valley entrepreneur and executive employment lawyer Jotham Stein has done it again.
In his newest book, “Even CEOs Get Fired,” Stein draws on decades of experience representing CEOs and other executives and employees to guide his readers through the key stages of the employment relationship. Stein engages the reader through the use of 59 lively fictional entrepreneur and executive stories about a wide range of employment situations. The stories underscore Stein’s readable explanation of the key stages of the employment relationship and how employees can improve their outcomes in these relationships.
Each chapter – such as “The Professional Prenuptial Agreement – AKA The Employment Contract” – closes with “Things to Remember.” For example, the Employment Contract chapter reminds readers to avoid certain widespread “equity pitfalls” after explaining precisely how to do that.
The book is accessible to the non-lawyer but does not shy away from explaining critical, if complex, employment terms, such as change in control provisions and the best way to handle the negotiation of a severance agreement. Yes, as Stein clearly and persuasively explains, these terms can be negotiated, and that can – and often does – lead to better outcomes for executives and other employees.
I highly recommend this book for a wide range of readers. It will certainly be useful to C-suite executives (because, after all, “even CEOs get fired”) but will prove equally useful to other employees occupying managerial roles at today’s corporations or aspiring to such a role, particularly, but not just, those in Silicon Valley or other high-tech centers.”
